Little Rose

Article 1: Definitions

1.1 Webstore: The online store that sells vintage goods and antiques, hereinafter referred to as "Little Rose."

1.2 Customer: Any natural or legal person who places an order via the webstore.

1.3 Products: All goods offered on the webstore.

1.4 Contract: Any contract between the customer and the webstore regarding the purchase and delivery of products.

Article 2: Applicability

2.1 These general conditions apply to all offers, quotations, orders, and agreements of the webstore.

2.2 By placing an order, the customer accepts the applicability of these general conditions.

Article 3: Offers and Agreements

3.1 All offers are free of obligation and are made subject to availability.

3.2 The contract is established when the customer places an order and receives an order confirmation.

3.3 The webstore reserves the right to refuse orders without giving reasons.

Article 4: Prices and Payment

4.1 All prices stated are in USD and include applicable taxes, unless otherwise indicated.

4.2 Payment should be made via the payment methods offered on the webstore.

4.3 If the customer defaults on payment, the webstore is entitled to cancel the order.

Article 5: Delivery

5.1 Delivery will be made to the address provided by the customer.

5.2 The webstore strives to ship orders within 7 working days. Delivery times are indicative and may vary.

5.3 Ownership of the products is transferred to the customer after full payment of the purchase price.

Article 6: Returns and Right of Withdrawal

6.1 Due to the unique, one-of-a-kind nature of our vintage and antique items, all sales are final. No returns, refunds, exchanges, or cancellations will be accepted once a purchase is completed, except where required by applicable consumer protection law. Please refer to Article 12 (Disclaimer) for full details.

Article 7: Warranty and Complaints

7.1 The webstore guarantees that the products meet the reasonable requirements of reliability and/or usability, considering that it concerns vintage or antique items.

7.2 The webstore does not guarantee the accuracy of descriptions, dimensions, and provenance of the products. The customer can therefore not derive any rights from this.

7.3 Complaints about the products should be made in writing within 4 days of receipt.

7.4 The webstore will make every effort to resolve complaints within a reasonable period.

Article 8: Liability

8.1 The liability of the webstore is at all times limited to the amount of the purchase price of the product.

8.2 The webstore is not liable for damages to the customer, or third parties related to (among other things, the purchase, delivery and/or use of) the products, or the use of the webstore.

8.3 The webstore is also not liable for any indirect damages, including consequential damages, lost profits, lost savings, and damage due to business stagnation.

Article 9: Privacy

9.1 The webstore processes personal data of the customer in accordance with applicable privacy laws and the privacy policy of the webstore.

9.2 The customer agrees to the processing of their personal data by placing an order.

Article 10: Applicable Law and Disputes

10.1 Aruban law applies to all legal relationships between the webstore and the customer.

10.2 Disputes will be submitted to the competent court in Aruba.

Article 11: Other Provisions

11.1 The webstore reserves the right to change these general conditions. Changes will take effect at the announced time.

11.2 If any provision of these general conditions is void or voidable, the remaining provisions will remain in full force.

Article 12: Disclaimer

General: All items sold by Little Rose are offered "as is" in their current condition. They may show wear, restoration signs, material inconsistencies, or other imperfections related to age, prior use, storage, or handling. These characteristics and/or imperfections do not constitute defects, nor do they form grounds for return, refund, or compensation claims.

Descriptions: Item descriptions and photographs are prepared in good faith for general guidance only. While we strive for accuracy, all information – such as age, origin, authenticity, provenance, dimensions, materials, and condition – is based on visual examination only (unless explicitly stated otherwise) and is provided without guarantee. Statements about objects are not warranties or binding assertions of fact. Deviations in colour, texture, size, or appearance are possible.

Provenance: Provenance references are given in good faith, where known or reasonably inferred, but may not always be accurate and/or fully documented. Attributions to period, origin, maker, or workshop reflect stylistic, material, and comparative assessment and may be subject to revision following further research or expert examination.

Materials: Where reference is made to materials of natural or animal origin (including, but not limited to, ivory, bone, horn, tortoiseshell, or similar), such identification is based on visual and contextual assessment only, unless explicitly stated otherwise. No scientific testing has been undertaken unless specifically mentioned. No representation or warranty is made as to the legal status, exportability, or regulatory compliance of such materials in any jurisdiction. Prospective buyers are encouraged to obtain independent expert advice where appropriate and to satisfy themselves as to any legal, regulatory, or customs requirements applicable to ownership, transport, or export.

No Warranties: Little Rose provides no warranties or guarantees, express or implied, to the fullest extent allowed by law. This includes, but is not limited to, any implied warranties of merchantability, fitness for a specific purpose, title, or non-infringement. Any descriptive statements concerning the condition, age, origin, or provenance of items are provided solely for general informational purposes and should not be interpreted as factual representations or binding guarantees. Little Rose does not assume liability for any such statements. All items are sold "AS IS".

Limitation of Liability: Little Rose will not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with the sale or use of any item, to the fullest extent permitted by law. If we are found liable for any reason, our maximum liability will not exceed the purchase price of the item.

Consumer Rights: Nothing in this disclaimer is intended to limit or exclude any rights you may have under applicable consumer protection laws.
